Conflict and independence

Technical advice often shapes what is later bought, regulated or financed. An expert with an undisclosed interest in the outcome, a firm advising on a tender it hopes to win, or an engagement with a sanctioned person can taint a whole procurement. This page sets out how conflicts of interest arise, how procurement neutrality is protected, how sanctions and debarment are screened, and what evidence the authorities who rule on these questions rely on.

01In brief

The short answer.

A conflict of interest is a situation in which an adviser's financial, professional or personal interests could compromise, or appear to compromise, their advice. In technical assistance, advice often shapes what is later bought or financed, so a firm advising on a tender it hopes to win, an undisclosed interest or an engagement with a sanctioned party can taint a whole procurement.

04The question

Conflict and independence: how the risk develops.

Conflicts, procurement neutrality and sanctions. The dossier below sets out how the risk develops, what is measured, where the data come from, how it is modelled and who decides.

Mechanism

Advice that shapes the tender

A consultant who prepares specifications, cost estimates or evaluation criteria and then bids for the resulting contract has an unfair advantage. Development bank procurement rules treat this as a conflict and exclude the firm unless the conflict is resolved.

Mechanism

Interests go undisclosed

Family ties, shareholdings, prior or prospective employment and gifts can bias advice without any visible breach. Declarations made once at engagement go stale as circumstances change.

Mechanism

Sanctions and debarment exposure

Engaging a person or firm on a sanctions list or debarment list can breach law and funding agreements. Development banks enforce one another's debarments, so exclusion by one bank can apply across several.

Mechanism

One conflict taints the chain

A conflict found late can lead to a misprocurement declaration, cancellation of financing for the contract, refund obligations, re-tendering and investigation. Delay then spreads to every activity that depended on the contract.

05Key terms

Terms used on this page.

Each term as this page uses it. Where a standard-setting body defines the term, the wording follows that body.

TermDefinition
DebarmentA decision that bars a firm or individual from contracts financed by an institution for a period.
Cross-debarmentAgreement among multilateral development banks to enforce one another's debarments.
RecusalWithdrawing from a decision or task because of a conflict of interest.
06Indicators

What is measured, and how well.

Each indicator carries its unit, its cadence, the kind of source behind it and the evidence label a value would carry. No values are shown: a programme supplies them under its own authority.

From sources to decisions.

The topic as a computational graph: named sources feed the methods, an evidence review gates the outputs, and the decisions stay with the authorities that hold them.

Outputs this topic produces

  • Screening records against named sanctions and debarment lists, with dates
  • Downstream-contract maps showing which advisory work shapes which procurement
  • Independence notes for procurement authorities and funders
10Core questions

What an independence check asks.

  • Does the expert have a financial, institutional or personal interest in the host, the subject or any competing party?
  • Could the assistance shape a future procurement in which the expert or their employer might bid?
  • Are any participants, hosts or locations subject to sanctions or eligibility restrictions?
  • Can the conflict be managed, or must the person step aside?
11Mechanisms

How independence is lost.

Conflicts are rarely dramatic. More often an adviser writes specifications that favour a familiar technology, a reviewer assesses a colleague's work, or an organization provides free assistance in the hope of later contracts. Each erodes the host's ability to rely on the advice.

Procurement neutrality addresses the most consequential case: assistance that shapes what a host will buy. People who help define a requirement should not then compete to supply it, and recommendations should describe functions rather than name products.

12Good practice

Signals of genuine independence.

  • Declarations made before selection, not after a concern is raised.
  • Recusals recorded with the decision they relate to.
  • Specifications that describe functions and performance, never named products.
  • Reviewers who are not in the reporting line of the people whose work they assess.

14Questions

Questions and answers.

Can a firm that prepared a feasibility study bid for the works?
Under most development bank rules, not if the study shaped the tender in a way that gives it an unfair advantage. The procurement authority decides, applying the rules of the financing agreement.
What is cross-debarment?
An agreement among multilateral development banks to enforce one another's debarment decisions that meet agreed criteria. A firm debarred by one bank can become ineligible at the others.
How often should sanctions screening be repeated?
At engagement, at renewal and when lists change in ways that may affect the parties. Each check should record the lists used and the date.
Does a declared conflict end an engagement?
Not necessarily. Many conflicts can be managed by recusal from specific decisions or by reassigning tasks. The ethics office or procurement authority decides whether mitigation is enough.
Does every interest disqualify someone?
No. Most interests can be managed by disclosure and recusal. Only conflicts that cannot be managed lead to the person stepping aside.
Can an expert later bid for work they helped scope?
The design is that they should not. Those who help define a requirement are excluded from supplying it.
Does free assistance create a conflict?
It can, if it is offered in the expectation of later contracts or influence. Such offers are declared and assessed like any other interest.
How do I report a suspected conflict?
Write to integrity@therisk.global. The acknowledgement gives a reference and names the next step.
