Scope and acceptance.
- 1.1 These Terms of Use govern access to and use of therisk.global and the platform sites published at addresses beginning with therisk.global/ (together, the Site). The Site is published by The Global Centre for Risk and Innovation (GCRI Canada), a Canadian not-for-profit organisation with its registered office in Ontario.
- 1.2 The main Terms and Conditions of GCRI Canada govern the use of all the websites of GCRI Canada. These Platform Terms add the terms specific to the platform sites, their tools, instruments, maps, data and participation routes. For a matter both documents address, the main document governs, except where these Platform Terms concern a platform feature they describe or give the user more protection. A French version of the main documents is available (Conditions générales).
- 1.3 By using the Site, a user accepts these Terms. A user who does not accept them should not use the Site.
- 1.4 Contributions are governed by the Contribution Terms, participation in consultations, working groups and events by the Participation and Events Terms, research outputs and datasets by the Research and Data Terms, and rights in material by the Intellectual Property and Licensing terms. Personal information is handled as set out in the privacy and cookie documents, the limits of the information are stated in the Disclaimers and Data Notices, and use of names and marks is governed by the Trademark and Name Use Policy.
- 1.5 Where a separately executed agreement between GCRI Canada and a user governs a matter, that agreement prevails over these Terms for that matter. These Terms do not govern any service, programme or membership that has its own terms.
Reuse of material.
- 2.1 Material on the Site may be reused under the licence stated on it. Where no licence is stated, it may be read and cited with attribution, and any other reuse needs permission. The Rights and licences page sets out the terms for each kind of material.
- 2.2 Material contributed by others and published on the Site keeps the licence under which it was contributed. Third-party material, such as satellite imagery, data, code libraries and bibliographic records, keeps its provider’s terms, which prevail for it. The Third-party notices list the credits and licences.
- 2.3 A licence does not extend to names and marks, and attribution under a licence does not imply that GCRI Canada or any contributor supports the user or the use made of the material.
Nature of the information.
- 3.1 GCRI is a research, development and policy institution. It is not a regulator, and it does not certify, license or approve; its findings carry their methods and uncertainty.
- 3.2 The information on the Site is provided for general information and voluntary use. It is not legal, regulatory, engineering, financial, investment, insurance, medical or safety advice, and it is not a substitute for the advice of a competent professional or the decision of a competent authority.
- 3.3 Maps, imagery, data and figures are shown for context with their source and date. The issuing provider’s own service is the authoritative source for them. Models, scenarios and figures that are illustrative are labelled as such.
No authority and no warnings.
- 4.1 The Site does not issue warnings, alerts, orders or emergency instructions and is not an emergency service. Only the competent public authority may warn, alert or command.
- 4.2 Nothing on the Site confers governmental or intergovernmental status, regulatory authority, privileges or immunities, or represents a country or its public powers, and nothing waives the privileges and immunities of any state or international organisation.
Sites covered.
Each of these platform sites is part of the Site and carries the same set of legal documents. A site that states its own additional terms applies them together with these.
Acceptable use.
- 6.1 The Acceptable Use Policy sets out in full the uses that are not allowed; the main rules follow.
- 6.2 Users shall not interfere with the operation or security of the Site, attempt to gain unauthorised access to any system, introduce malicious code, or make automated requests at a volume that impairs availability for others.
- 6.3 Users shall not misrepresent an affiliation with the publisher, present material of the Site as issued or approved by a body that has not done so, or impersonate the publisher, its staff or any other person.
- 6.4 Users shall not use the Site in breach of an applicable law, including sanctions and export-control laws, or to harass, defame or infringe the rights of others.
- 6.5 Good-faith security research is welcome when it is reported privately to the contact form, without exploit details or personal data in a first message, and is not disclosed publicly before a fix or an agreed date.
Intellectual property.
- 7.1 Unless the Site states otherwise, GCRI Canada or its contributors own the copyright in the original text, figures and software of the Site, which is made available under the licences stated on it. Rights not expressly granted are reserved.
- 7.2 The Site’s names, emblems and visual identity are not licensed by any content licence; see the Trademark and Name Use Policy.
Links and third-party services.
- 8.1 Links to other sites are provided for convenience. The publisher does not control those sites and is not responsible for their content, availability or privacy practices.
- 8.2 Some pages request maps, imagery or data from third-party services when they are shown. The Cookie Policy lists those services.
Availability, suspension and changes.
- 9.1 The Site is provided on an as-available basis and may be changed, suspended or withdrawn, in whole or in part, without notice, in particular for maintenance, security or editorial reasons.
- 9.2 The publisher may restrict access for a user who breaches these Terms or whose use threatens the security or availability of the Site.
Disclaimer of warranties.
- 10.1 To the extent permitted by law, the Site and its material are provided as is and as available, without warranty of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title and non-infringement.
- 10.2 Nothing in these Terms excludes or limits a warranty or a right that cannot be excluded or limited under the law that applies to the user, including the rights of consumers.
Limitation of liability.
- 11.1 To the extent permitted by law, GCRI Canada and its directors, staff, volunteers and contributors are not liable for any loss or damage arising from the use of, or reliance on, the Site or its material, including indirect, incidental, special, consequential or punitive damages and loss of data, revenue or profit.
- 11.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, for intentional or grossly negligent conduct where the law does not allow that liability to be limited, or any other liability that cannot be excluded or limited by law.
Governing law and disputes.
- 12.1 These Terms and any dispute about the Site, including a non-contractual dispute are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules that would apply another law.
- 12.2 The default forum for disputes arising from these Terms is the courts of the Province of Ontario sitting in Toronto, as the default forum, without excluding any forum that mandatory consumer-protection law or the constituent instruments of a public body or international organisation require.
- 12.3 A user who uses the Site as a consumer keeps the protection of the mandatory law of the country where the user lives and any right to bring proceedings in its courts that cannot be excluded by agreement.
- 12.4 Before any proceeding, users are invited to raise the matter with the publisher at the contact form, which will seek to resolve it by dialogue. Nothing in this section submits a state or an international organisation to the jurisdiction of any court, or waives any immunity.
Language, changes and general provisions.
- 13.1 These Terms are drawn up in English. Where a translation is published, the English text prevails to the extent permitted by law.
- 13.2 The publisher may amend these Terms. The amended Terms are published on this page with a new version and effective date and apply to use of the Site from that date; earlier versions are available on request.
- 13.3 If any provision is held invalid or unenforceable, the remaining provisions remain in effect. A failure or delay in enforcing a provision is not a waiver of it. A user may not assign rights under these Terms; the publisher may assign them to a successor institution of the same public-interest purpose.
- 13.4 Notices to the publisher are sent to the contact form. Notices to users are published on the Site or sent to an address a user has given for the purpose.
